Green Card Lottery – What is it?

The annual Green Card Lottery is known officially as the Diversity Immigrant Visa (DV) Program or the Diversity Visa Program (DV). The abbreviation DV is usually followed by two numbers designating the year; for example, DV-19 for the Green Card Lottery for the year 2017. The idea behind the lottery is to keep the United States of America diverse, therefore Green Cards won in the lottery are under the Diversity Visa category.

The first Green Card Lottery was held in 1994. The application process, however, was not without its difficulties. American Visa Lottery Application Details

The only way to officially apply for a green card lottery is to apply online at the Dept. State website. Beware of any other non-government websites that charge fees for this free application.

The online form that you fill is called Form DS-5501, Electronic Diversity Visa Entry Form, that is available only during the DV open registration period.

You can not download the form and fill it out. Starting with DV-2005, paper entries are not accepted. Online process makes the process more efficient and secure. Moreover, Department of State uses the special technology and other means to identify the persons who commit fraud or illegal immigration or those who submit multiple entries.

You should not wait until the last week of the registration period as there may be heavy demand and it may result in the web site delays.

If you do not fill the online form completely, your entry will be disqualified.

Regardless of who made the entry, if you make more than one entry, all of your entries will be disqualified. Regardless of who made the entry, you are completely responsible for making sure that information in the entry is correct and complete.

Do not send any documents (birth certificate, work experience, school records etc.) anywhere, other than making an online entry.

These are real scam letters and checks sent to us by our readers.  You will note that some of the materials are very easy to see that it’s a scam, and others look authentic.  But for those who don’t know anything about lottery games, even the clear forgeries can look real.

In the sample letters, see if you can spot:

  • The misspelling «Congradulations»
  • Prize description does not match the game they are referring to (Mega Millions does not have a prize category «A», whatever that is)
  • Use of USA Mega logo, to try to make the letter seem legitimate
  • The barcode at the bottom, to try and make the letter seem legitimate, except the barcode reads «0123456789» — not exactly a realistic code!
  • Just the fact that you’re getting a letter at all is odd.  In Mega Millions you buy tickets, and the lottery has no idea who the winners are before they walk into lottery headquarters and redeem the ticket.  Think about it: isn’t that why you hear about unclaimed jackpots all the time?  The lottery has no idea who to tell about the win, because all tickets are bought anonymously!

National lottery USA

Lotteries in the United States did not always have sterling reputations. One early lottery in particular, the National Lottery, which was passed by Congress for the beautification of Washington D.C. and was administered by the municipal government, was the subject of a major U.S. Supreme Court decision Cohens v. Virginia.

The lottery never paid out, and it brought to light the prevalent issue of crookedness amongst the lotteries in the United States. The wave of anti-lottery protests finally broke through when, by 1860, all states had prohibited lotteries except Delaware, Missouri, and Kentucky. In 1868, after years of illegal operation, the Louisiana Lottery Company obtained a 25-year charter for its state lottery system. The charter was passed by the Legislature due to immense bribing from a criminal syndicate in New York. The Louisiana Lottery Company was a derived 90% of its revenue from tickets sold across state borders. These continued issues of corruption led to the complete prohibition of lotteries in the United States by 1895. It was discovered that the promoters of the Louisiana Lottery Company had accrued immense sums of money from illegitimate sources and that the Legislature was riddled with bribery.

Before the advent of government-sponsored lotteries, many illegal lotteries thrived, such as number games. The first modern government-run US lottery was established in Puerto Rico in 1934. This was followed, decades later, by the New Hampshire lottery in 1964. Instant lottery tickets, also known as scratch cards, were introduced in the 1970s and have become a major source of lottery revenue. Individual lotteries often feature three-digit and four-digit games akin to numbers games; a five number game, and a six number game (the latter two often have a jackpot.) Some lotteries also offer at least one game similar to keno, and some offer video lottery terminals. Presently, many US lotteries support public education systems.

Please take note that your nationality plays no role in the Green Card Lottery. Only your country of birth according to current borders is important in deciding if you can participate in the drawing.

Exceptions for people born in an excluded country

There are, however, exceptions! People who were born in an excluded country can still apply to the Green Card Lottery under certain conditions. They are when:

  1. The spouse of the participant was born in a country that can actively participate;

or

  1. People born in an excluded country can participate if their parents were only in the country of their birth temporarily for, for example, their studies or work. In this case, both parents must have been born in a country which can participate in the lottery.  

In these cases, the participant can take on, so to say, the country of their parents or spouse and enter the country as their “native country” when applying. American Visa Lottery Application Confirmation

Once you successfully register the entry, you will see a confirmation screen that contains your name and a unique confirmation number. Print this confirmation screen for your records. You will need this confirmation number in order to  the status online, starting March of the next year.

If you lose the confirmation page (or number), the only way to know whether you have been selected in the lottery would be if you receive an official letter by post. The KCC cannot resend the confirmation page or number to you.

How do the scams work?

Often, the scams will put USA Mega or some other recognizable name or logo on the paper to make it look official.

Also, most times the scam artists will also include a very real-looking check for a few thousand dollars.  Keep in mind, the check is not real — if you went to cash it, the check would be worthless.  But it looks real, making you very excited at this point that you’ve actually won something.

The scams always boil down to this: they want you to send them money.  Most of the time, they claim that you need to send them the taxes on your prize.  After all, they sent you the check, so why not just deposit the check, and then send them the money from your account via Western Union?

That’s the key.  They are trying to get you to send your real money from your bank account, in exchange for their fake check that they gave you.

Lotteries in the United States

In the United States, lotteries are run by 47 jurisdictions: 44 states plus the District of Columbia, Puerto Rico, and the U.S. Virgin Islands. Lotteries are subject to the laws of and operated independently by each jurisdiction, and there is no national lottery organization. However, consortiums of state lotteries jointly organize games spanning larger geographical footprints, which in turn, carry larger jackpots. Gambling as a generalization has roots in the United States and other English colonies as far back as the 1600s. Not every colony allowed gambling, however.
